Steps by India 

  • India stands committed to increase its overall health allocations to 2.5% of its GDP as enunciated in the National Health Policy, 2017. 

  • There has been a 66% decline in the estimated number of annual new HIV infections in the country from 2000 to 2015, against the global average of 35%. AIDS related deaths declined by 54% from 2007 to 2015 against the global average of 41% decline during 2005 - 2015.

  • The Union Ministry of Health and Family Welfare launched the National Strategic Plan 2017-24 aimed at eradicating HIV/AIDS by 2030. 

 

National Strategic Plan 2017-24

  • The goals remain those of the ‘Three Zeros’ - i.e. zero new infections, zero AIDS-related deaths and zero discrimination which form the basis of this strategic plan.

  • By 2020, the focus of the national programme will be on achieving the following fast track targets:

(i) 75% reduction in new HIV infections,

(ii) 90-90-90: 90% of those who are HIV positive in the country know their status, 90% of those who know their status are on treatment and 90% of those who are on treatment experience effective viral load suppression,

(iii) Elimination of mother-to-child transmission of HIV

(iv) Elimination of stigma and discrimination Paving Way for an AIDS Free India

  • By 2024, the further achievements envisaged are:

(i) 80% reduction in new HIV infections,

(ii) Ensuring that 95% of those who are HIV positive in the country know their status, 95% of those who know their status are on treatment and 95% of those who are on treatment experience effective viral load suppression

  • It aims to attain universal coverage of HIV prevention, treatment to care continuum of services that are effective, inclusive, equitable and adapted to needs of the people living with HIV. It will also pave a roadmap not only for achieving the target of 90:90:90 Strategy. 

  • 90:90:90 Strategy : It is a new HIV treatment narrative of UNAIDS programme which has set targets of 90% of all people living with HIV will know their HIV status (90% diagnosed), 90% of all people with diagnosed HIV infection will receive sustained antiretroviral therapy (90% on HIV treatment) and 90% of all people receiving antiretroviral therapy will have viral suppression (90% suppressed).

  • Mission SAMPARK was launched to trace those who are Left to Follow Up and are to be brought under Antiretroviral therapy (ART)services.

  • The Government is also implementing 360-degree multimedia campaigns along with mass media supported by outdoor media such as hoardings, bus panels, information kiosks, folk performances and exhibition vans to create awareness on HIV/AIDS and promoting services/facilities across the country. At the inter-personal level, training and sensitization programmes for Self-Help Groups, Anganwadi workers, ASHA, members of Panchayati Raj Institutions and other key stakeholders are also being organized to spread awareness about treatment and other facilities.

  • In addition, awareness activities are conducted amongst High Risk Groups including Female Sex Workers, Men having Sex with Men, Injecting Drug Users, Hijra/ Transgender and Bridge Population like truck drivers, migrants etc. as part of Targeted Intervention projects.

  • There is a software to maintain the details of the patients to enable them on regular treatment. Also, counsellors ensure tracking of HIV positive patients through telephone and home visits in the case of those who drop out between diagnosis and treatment to maintain their adherence to treatment.

 

 

HIV & AIDS (Prevention and Control) Act, 2017

  • The Government of India has enacted the HIV & AIDS (Prevention and Control) Act, 2017. The Act addresses discrimination against People Living with HIV (PLHIV) at workplace, education setting, health setting and public places.

  •  It also provides a robust grievance redressal mechanism where compliant against discrimination would be disposed by Ombudsman at the state level.

  •  It prohibits isolation of segregation of an HIV-positive person

  • No HIV-affected person can be subject to medical treatment, medical interventions or research without informed consent. Further, no HIV positive woman, who is pregnant, can be subjected to sterilization or abortion without her consent.

  • No person is compelled to disclose his HIV status except by an order of the court. A breach of violation attracts a jail sentence of up to two years or a fine of up to Rs 1 lakh, or both.

  • The state and Centre must make diagnostic facilities, anti-retroviral therapy and opportunistic infection management available to all HIV-infected people and ensure wide dissemination of the same.

  • Every state has to appoint one or more Ombudsmen to inquire into violations of the provisions of the Act. Within 30 days of receiving a complaint, the Ombudsman is required to pass an order as he deems fit. Failing to comply with the orders of the Ombudsman attracts a penalty of up to Rs 10,000

Context : The International Monetary Fund (IMF) in its “World Economic Outlook” Report has cut India’s growth forecast for 2019-20 to 7% from its forecast in April of 7.3%.

 

About the World Economic Outlook Report

  • This report is published twice a year and analyses the global economic developments during the near and medium term.

 

Highlights about the Report

  • Sluggish Global growth: The report highlights that the global economic growth is expected to remain subdued at 3.2% due to US-China Trade wars, uncertainty over Brexit and impact of rising geopolitical tensions on international crude oil prices.

  • Investment and consumption expenditure: The report has further highlighted that investment and consumption expenditure has remained subdued both in the advanced and developing economies leading to slowdown in their growth rates.

  • India’s GDP Forecasts: In April 2019, the report had forecasted the GDP to grow at 7.3%. However, in its latest edition, it has highlighted that the GDP growth may slow down to 7% due to subdued consumption expenditure.

 

Way forward

  • Multilateral and national policy actions are vital to place global growth on a stronger footing

  • Thus, there is a need to address issues related to trade wars and geopolitical tensions.

  • Both the advanced and developing economies may opt for policy cuts in order to boost their consumption and investment expenditure.

Context:  India has set a goal of 100% electrification for which it will have to double its

installed power capacity. And to achieve this doubled capacity , Coal has been projected to be the backbone of the electricity sector till 2030 and beyond.

 

Issues with TPPs

  • Thermal power plants (TPPs) consume significant amounts of water during the electricity generation process. Most of India’s TPPs are located in water-stressed areas, and water shortages have led to electricity-generation disruptions and significant revenue losses to the economy.

  • The Ministry of Environment, Forest and Climate Change issued a notification in 2015 setting limits for water consumption by TPPs. However these limits were relaxed by a later amendment.

 

What needs to be done to control the water Usage by TPPs?

  • The Central Electricity Authority (CEA) recently released the format for TPPs to report on their annual water consumption

  • the power plants were asked to specify both metered and un-metered usage, report on the source (like river, canal or sea), and state the percentage of deviation from the water norms, along with the reasons and the corrective measures undertaken.

 

However these regulations can be further be strengthened by some of the suggestions : 

 
  • First, TPPs should disclose the amount of water consumed by them in previous years, so that a baseline for water consumption per TPP can be established, and subsequent reductions in water consumption can be quantified.

  •  Second, these reporting requirements — currently in the form of an Excel sheet on the CEA website — must be added to the Environment Protection Rules, to accord the disclosure process greater transparency and enforceability.

  • Third, TPPs should also be required to submit verifiable evidence (for example, water bills) to support and substantiate the disclosures the data supplied by TPPs should be placed in the public domain

 

Penalties under EPA act:

  • Section 15 of the EP Act provides for a blanket penalty for contravention of any provisions of the Environment Protection Act or EP Rules. However, the Act does not stipulate specific penalties for specific offences.

  • Thus specific penalties should be provided for controlling water consumption by TPPs

  • The relevant officials in charge of enforcement, across the Ministry and the CEA, should be identified, and their roles clearly defined. The implementation of these norms should include milestones and time-based targets, and periodic monitoring of the progress of TPPs in making improvements.

 

Conclusion :In addition to reducing the stress caused by TPPs, shifting to a more aggressive RE pathway will help India achieve its global climate targets. India will need to balance the needs of its growing economy with its heightening water stress.

Register of Indigenous Inhabitants of Nagaland (RIIN)

Highlights

Context :In this article, the author is highlighting the difficulties the Nagaland govt will face will compiling the list of indigenous inhabitants

 

Background

  • Recently the Nagaland govt has decided to compile a Register of Indigenous Inhabitants of Nagaland (RIIN), which will be like a master-list of all indigenous inhabitants of the State.

  • Following this, every indigenous inhabitants of the State will be provided with a unique barcoded and numbered indigenous inhabitant certificates.

  •  All existing indigenous inhabitant certificates would become invalid once the process of compiling RIIN is completed and fresh certificates issued.

  • The main purpose of this exercise is to curb the duplication/ circulation of fake indigenous inhabitants certificates which are granted by the state government.

 

Possible challenges

 

1. Selection of the cut-off date :

  • Though the official notification on RIIN has not mentioned a cut-off date to compile the proposed register, the authorities in Nagaland have till date issued indigenous inhabitant certificates using December 1, 1963 as the cut-off date (Nagaland was inaugurated as India’s 16th State on this date).

  • Since 1977, a person, in order to be eligible to obtain a certificate of indigenous inhabitants of Nagaland, has to fulfil either of these three conditions: a) the person settled permanently in Nagaland prior to December 1, 1963; b) his or her parents or legitimate guardians were paying house tax prior to this cut-off date; and c) the applicant, or his/her parents or legitimate guardians, acquired property and a patta (land certificate) prior to this cut-off date.

  •  If the Nagaland government goes ahead with a compilation of RIIN with this cut-off date, then all Naga people who have migrated to the State (Nagaland) from the neighbouring States of Assam, Manipur and Arunachal Pradesh and elsewhere in India after this day will have to be excluded.

 

2. The compilation of RIIN also involves the complexities of deciding claims in respect of

children of non-Naga fathers as well as non-Naga children adopted by Naga parents.

 

3. Opposition from NSCN :

  • The National Socialist Council of Nagalim (Isak-Muivah), which has been engaged in peace talks with the government of India since 1997, has opposed the compilation of RIIN asserting that “all Nagas, wherever they are, are indigenous in their land by virtue of their common history”.

  • Further, the Centre and the NSCN (I-M), which is the largest among all armed Naga rebel groups, signed a Framework Agreement in 2015, the content of which has still not been made public, in turn leaving room for speculation on the contentious issue of integration of all contiguous Naga-inhabited areas of Assam , Nagaland,  Manipur and Arunachal Pradesh.

 

3. linking with the Inner Line Permit :

  • There is a strong possibility that this RIIN will be linked with the Inner Line Permit system ( The ILP is a travel document issued by government to allow a citizen of India to visit Nagaland and Arunachal Pradesh and Mizoram)

  •  The proposed linking of RIIN with the ILP system may require large numbers of non- indigenous inhabitants of Dimapur district, more particularly the commercial hub (Dimapur town), to obtain an ILP to carry out day-to-day activities (currently ILP is not required in Dimapur) .

  •  Most of these people migrated from other States to Nagaland and have been carrying out trade, business and other activities for decades.

  • A report prepared by the government, in collaboration with the UNDP in 2009, gave information on migration patterns in Nagaland. It said that in 2001, Assam was the State with the highest number of migrants to Nagaland (19,176 people), followed by Bihar (7,249 people) and Manipur (4,569 people). A large section of people had migrated for better employment and business opportunities.

  • Due to presence of such large number of non-indigenous people, the Nagaland govt has also decided to extend ILP to Dimapur.

  • While the move to streamline the ILP system to curb the influx of “illegal migration” to Nagaland has been welcomed by civil society, public opinion is still divided on compiling RIIN without a consensus on the cut-off date.

  • Besides this, the complexities that may arise in streamlining the ILP mechanism due to - non-issuance of domicile certificates or permanent residence certificates to a large number of non-Naga, hence the non-indigenous inhabitants can make the task of compiling the RIIN difficult for the government.

Editorial Focus: India's relationship with South Korea has improved significantly in the recent past and there is more potential for further development in relationship. 

Principles of relationship:

 

  • India & South Korea consider their relationship to be a ‘Special Strategic Partnership’ built on the foundations of: Deep-rooted historical and cultural bonds, shared universal values of democracy, free market economy, rule of law, peaceful, stable, secure, free, open, inclusive and rules-based region.

  • India considers South Korea as a partner in its ‘Act East’ policy and similarly, South considers India a central pillar in its ‘New Southern Policy’.  

 

Security relationship:
 

  • The emerging securitisation of the Indo-Pacific region has also led to growing defence relationship between India and South Korea.

  • Both countries have started co-production of the K9 Thunder howitzer as part of their ongoing defence collaboration. 

  • Additionally, there is regular security dialogue between India’s National Security Adviser and the intelligence agencies of South Korea.

  • South Korea also supports India’s membership to the Nuclear Suppliers Group. 

 

US - China Trade War:
 

  • The ongoing trade war between U.S. and China has also led to potential of South Korean investment into India.  

  • South Korean companies are now finding it more difficult to sell their products in the U.S. if they are being produced in their Chinese branches. 

  • Therefore South Korean companies intend to move their production facilities from China to other countries, and India is considered as a prime location due to existing facilities of South Korean companies in India, cheap labour, stable legal system and export infra. in coastal States. 

  • Samsung which as a South Korean company formed a new manufacturing facility in Noida, Uttar Pradesh in 2018, which is perhaps the largest mobile phone manufacturing plant for Samsung anywhere in the world, reflecting South Korean partnership in ‘Make in India’ program.

 

Bilateral Trade:
 

  • Today the major items that India exports to South Korea include mineral fuels, oil distillates, cereals and, iron and steel. South Korea’s main exports to India include automobile parts and telecommunication equipment, among others.

  • The trade target of $50 billion by 2030 between both countries is most likely to be missed due to lack of adequate efforts. The Comprehensive Economic Partnership Agreement has now become stagnant but both countries have not agreed upon parameters of upgradation. 

  • An early harvest agreed to last year, under which India agreed to reduce tariff on 11 commodities and South Korea on 17, failed to see completion.

  • Both countries are awaiting conclusion of RCEP FTA to fuel trade but reliance on RCEP should be avoided due to several concerns by India with RCEP and doubtful Indian membership.

 

Social-cultural relations:
 

  • Indi has not been able to create a distinct image in South Korea. South Koreans still fail to differentiate between India and Indonesia.  There is still social and economic discrimination against Indians working and living in South Korea.

  • India & South Korea are working on a monument of Queen Suriratna (Hur Hwang-ok) in Ayodhya as a joint project to celebrate their shared heritage. 

  • Princess Suriratna was a legendary Princess of Ayodhya, who went to Korea in AD 48 and married King Kim-Suro of Royal Korean family. A large number of Koreans trace their ancestry to this legendary princess. 

 

Korean Peninsula denuclearisation:
 

  • India & South Korea committed their support for complete denuclearization as well as lasting peace and stability in the Korean Peninsula. 

  • Both countries would work together to prevent proliferation of weapons of mass destruction and delivery systems, particularly to terrorists and non-state actors. 

  • There had been reports that in Pakistan aided North Korea’s nuclear program, in exchange for North Korean aid in its missile program.

ContextInter-Ministerial Committee on Virtual Currencies headed by finance secretary Subhash Chandra Garg has submitted its report to the government. The committee set up by Centre has also proposed a draft bill ‘Banning of Cryptocurrency & Regulation of Official Digital Currency Bill, 2019’.

 

Key recommendations:

  1. Ban on all forms of private cryptocurrencies.
  2. Impose a fine of up to Rs 25 crore and imprisonment of as much as 10 years for anyone dealing in them.
  3. RBI and the government may look at the introduction of an official digital currency in the country
  4. Establish a specific group by the department of economic affairs with participation by the RBI, department of financial services and the ministry of electronics and information technology (MeitY) for examining and developing an appropriate model of digital currency in India.
  5. The panel backed use of distributed ledger technology (DLT) or blockchain for selected areas. It has asked the department of economic affairs to take the necessary measures to facilitate the use of DLT in the financial field after identifying its uses. 
  6. It has also suggested the use of DLT to reduce compliance costs for know-your-customer (KYC) requirements.
  7. Data localisation requirements proposed in the draft Data Protection Bill may need to be applied carefully, including with respect to the storage of critical personal data so as to ensure that there is no adverse impact on Indian firms and Indian consumers who may stand to benefit from DLT-based services. 

 

Implications:

The recommendations, if accepted by the government, will be a blow to digital currency aspirants in India such as Facebook as well as exchanges currently operating in the country by circumventing Reserve Bank of India (RBI) norms by undertaking peer-to-peer trading.

 

Definition:

Cryptocurrency has been defined as “any information or code or number or token not being part of any official digital currency, generated through cryptographic means or otherwise, providing a digital representation of value which is exchange with or without consideration, with the promise or representation of having inherent value in any business activity which may involve risk of loss or an expectation of profits or income, or functions as a store of value or a unit of account and includes its use in any financial transaction or investment, but not limited to, investment schemes.”

 

Why IMC proposed Ban on Cryptocurrency?

  1. All the cryptocurrencies have been created by non- sovereigns and are in this sense entirely private enterprises.
  2. There is no underlying intrinsic value of these cryptocurrencies back they lack all the attributes of a currency.
  3. There is no fixed nominal value of these private cryptocurrencies i.e. neither act as any store of value nor they are a medium of exchange.
  4. Since their inceptions, cryptocurrencies have demonstrated extreme fluctuations in their prices.
  5. These crytocurrencies cannot serve the purpose of a currency. The private cryptocurrencies are inconsistent with the essential functions of money/currency, hence private cryptocurrencies cannot replace fiat currencies.
  6. A review of global practices show that they have not been recognised as a LEGAL tender in any jurisdiction.
  7. Committee also recommends that all exchanges, people, traders and other financial system participants should be prohibited from dealing with cryptocurrencies.

Context: Ministerial meeting of Coordinating Bureau of Non-Aligned Movement (NAM) was held recently in Caracas, capital of Venezuela.

Issues raised by India at NAM Meet included- Climate change, Digital Technologies and Terrorism.

 

Suggestions by India:

  1. Non-Aligned Movement (NAM) needs to be re-examined and revise its methodology.
  2. The grouping needs to undertake a new journey.

 

About NAM:

  • Founded in 1961 in Belgrade.
  • It was created by the heads of Yugoslavia, India, Egypt, Ghana and Indonesia.
  • The Non-Aligned Movement was formed during the Cold War as an organization of States that did not seek to formally align themselves with either the United States or the Soviet Union, but sought to remain independent or neutral.
  • The movement represented the interests and priorities of developing countries. The Movement has its origin in the Asia-Africa Conference held in Bandung, Indonesia in 1955.

 

Key features of the NAM policy:

  1. The policy of non-alignment was based on the five principles of Panchasheel, which directed international conduct. These principles which were envisaged and formulated in 1954, were mutual respect for each other’s territorial integrity and sovereignty; non interference in each other’s military and internal affairs; mutual non aggression; equality and mutual benefit and finally, peaceful coexistence and economic cooperation
  2. The policy of non-alignment meant the acceptance of the inevitability of warbut on the conviction that it could be avoided.
  3. The non-aligned movement emerged from India’s initiative for formulating an independent foreign policy.
  4. This independent foreign policy was based on a solid moral and sound political foundation.
  5. The non-alignment was a strategy designed to maximise newly independent India’s gainsfrom the world system. Nonalignment did not mean to choose to become a hermit kingdom.

 

How has NAM benefited India?

  1. NAM played an important role during the Cold War years in furthering many of the causes that India advocated: Decolonisation, end to apartheid, global nuclear disarmament, ushering in of new international economic and information orders.
  2. NAM enabled India and many newly born countries in 1950’s and 1960’s their sovereignty and alleviated the fears of neo-colonialism.
  3. Soft-Power Leadership:NAM made India a leader for many countries who didn’t want to ally with the then global powers USA or USSR. India became a soft-power leader which still holds good till date.
  4. Balanced friendship:India’s non-alignment gave her the opportunity to get the best of both the global superpowers of the time in terms of aid, military support etc. This was in line with her objectives of national development.

 

Why NAM’s authority is said to be slowly eroding?

  • The end of cold war lead to unipolar world and now tending towards multi-polarity. The NAM is now reached irrelevance.
  • NAM could not push for reforms in the global bodies like UN, IMF, WTO.
  • Inability to find solution to the West-Asian crisis. Withdrawal of one of the founder members- Egypt, after the Arab Spring.
  • Most of the members are economically weak; hence they have no say in world politics or economy.

What is Simla Agreement and How it is Relevant Amid Trump’s Kashmir Mediation Gaffe

 

What to study?

For prelims and mains: Simla agreement- origin, impact and outcomes, has it been successful?

 

Context: Donald Trump’s offer to help India and Pakistan resolve the Kashmir issue has snowballed into a major controversy after India refuted the US President’s claim that Prime Minister Narendra Modi had made a request in this regard.

With this, the focus has shifted back on past “bilateral agreements”, including the 1972 Simla Agreement.

 

India’s response:

India has reiterated its longstanding position that there is no room for mediation in Kashmir or on any other India-Pakistan issue and that all outstanding matters between the two countries would be resolved through bilateral dialogue — but only when Pakistan ends cross-border terrorism in India.

 

What is Simla Agreement and why was it signed?

The Simla Agreement was signed by Prime Minister Indira Gandhi and Pakistani President Zulfikar Ali Bhutto on 2 July 1972, following a full-blown war between India and Pakistan in 1971.

The Simla Agreement was “much more than a peace treaty seeking to reverse the consequences of the 1971 war (i.e. to bring about withdrawals of troops and an exchange of PoWs).” It was a comprehensive blue print for good neighbourly relations between India and Pakistan.

Under the Simla Agreement both countries undertook to abjure conflict and confrontation which had marred relations in the past, and to work towards the establishment of durable peace, friendship and cooperation.

The two countries not only agreed to put an end to “conflict and confrontation” but also work for the “promotion of a friendly and harmonious relationship and the establishment of durable peace in the sub-continent, so that both countries may henceforth devote their resources and energies to the pressing talk of advancing the welfare of their peoples.”

 

How was this to be achieved?

  1. In order to achieve this objective, both the governments agreed that that the principles and purposes of the Charter of the United Nations would govern bilateral relations and differences would be resolved by “peaceful means through bilateral negotiations or by any other peaceful means mutually agreed upon between them.” 
  2. Regarding Jammu and Kashmir, the two sides had agreed that the line of control “resulting from the cease-fire of December 17, 1971 shall be respected by both sides without prejudice to the recognized position of either side. Neither side shall seek to alter it unilaterally, irrespective of mutual differences and legal interpretations. Both sides further undertake to refrain from the threat or the use of force in violation of this Line.”
  3. Both governments had also agreed that their respective Heads would meet again at a “mutually convenient time in the future the representatives of the two sides will meet to discuss further the modalities and arrangements for the establishment of durable peace and normalization of relations, including the questions of repatriation of prisoners of war and civilian internees, a final settlement of Jammu and Kashmir and the resumption of diplomatic relations.”

 

India had three primary objectives at Shimla:

  1. First, a lasting solution to the Kashmir issue or, failing that, an agreement that would constrain Pakistan from involving third parties in discussions about the future of Kashmir. 
  2. Second, it was hoped that the Agreement would allow for a new beginning in relations with Pakistan based upon Pakistan’s acceptance of the new balance of power.
  3. Third, it left open the possibility of achieving both these objectives without pushing Pakistan to the wall and creating a revanchist anti-India regime.

Kala Azar

Background:

Kala-azar is endemic to the Indian subcontinent in 119 districts in four countries (Bangladesh, Bhutan, India and Nepal).

This disease is the second-largest parasitic killer in the worldElimination is defined as reducing the annual incidence of Kala Azar (KA) to less than 1 case per 10,000 people at the sub-district level.

 

Kala-azar:

What is it? Visceral leishmaniasis (VL), also known as kala-azarblack fever, and Dumdum fever, is the most severe form of leishmaniasis and, without proper diagnosis and treatment, is associated with high fatality.

Spread: Caused by protozoan parasites of the Leishmania genus, migrates to the internal organs such as the liver, spleen (hence “visceral”), and bone marrow.

Signs and symptoms include fever, weight loss, fatigue, anemia, and substantial swelling of the liver and spleen.

India enters 37-year period of demographic dividend

 

What to study?

For prelims and mains: TFR, demographic dividend- meaning, opportunities and challenges.

 

Context: Since 2018, India’s working-age population (people between 15 and 64 years of age) has grown larger than the dependant population (defined as children aged 14 or below as well as people above 65 years of age).

This bulge in the working-age population is going to last till 2055, or 37 years from its beginning.

 

Significance:

This transition happens largely because of a decrease in the total fertility rate (TFR, which is the number of births per woman) after the increase in life expectancy gets stabilised. 

Many Asian economies — Japan, China, South Korea — were able to use this ‘demographic dividend’, defined by the United Nations Population Fund (UNFPA) as the growth potential that results from shifts in a population’s age structure.

 

What does the data say about India’s TFR?

The government’s Sample Registration System in 22 states shows that TFR for India declined to 2.2 in 2017 after being stable at 2.3 between 2013 and 2016. TFR indicates the average number of children expected to be born to a woman during her reproductive span of 15-49 years.

 

How does TFR vary between urban and rural areas?

The total fertility rate has more than halved in both urban and rural areas, falling even below the replacement level in the former where it is 1.7, down from 4.1 in 1971. In rural areas, TFR has fallen from 5.4 to 2.4 during the same period. For rural areas, it varies from 1.6 in Delhi and Tamil Nadu to 3.3 in Bihar. For urban areas, the variation is from 1.1 in Himachal Pradesh to 2.4 in Uttar Pradesh and Bihar. Of the 22 states, only six have a TFR of 2 or more in urban areas. There are 10 states where TFR is below 2 in rural regions.

 

How does fertility vary between age groups?

The 25-29 age is the most fertile, except in Bengal, Chhattisgarh, Andhra Pradesh and Maharashtra, where it peaked between 20 and 24. Only J&K hits the peak after 30.

 

Why is TFR falling?

Higher education, increased mobility, late marriage, financially independent women and overall prosperity are all contributing to a falling TFR. It goes below 2 in both urban and rural areas, where girls complete schooling and reduces further as they pass college. Bihar, with the highest TFR of 3.2, had the maximum percentage of illiterate women at 26.8%, while Kerala, where the literacy rate among women is 99.3%, had among the lowest fertility rates. As more cities come up, people move for jobs and employment tenure gets shorter, TFR may fall further.

 

What does this mean for policymakers?

  1. India has entered a 37-year period of demographic dividend, which could spell faster economic growth and higher productivity.
  2. As such, the government needs to engineer its policies to harness the opportunity.
  3. It must also formulate policies to take care of higher medical costs as the population ages and productivity shrinks.
  4. As more people live away from their parents, India will also need to have an affordable social security system that provides pension to the elderly and takes care of their daily needs and medical expenses.

Context:  American digital payments player PayPal is working with its partners on localisation of data as mandated by the Reserve Bank of India.

 

What does Data Localization mean?

Data localization is the act of storing data on any device that is physically present within the borders of a specific country where the data was generated.

 

Why data localization is necessary for India?

  1. For securing citizen’s data, data privacy, data sovereignty, national security, and economic development of the country.
  2. Recommendations by the RBI, the committee of experts led by Justice BN Srikrishna, the draft ecommerce policy and the draft report of the cloud policy panel show signs of data localisation.
  3. The extensive data collection by technology companies, has allowed them to process and monetize Indian users’ data outside the country. Therefore, to curtail the perils of unregulated and arbitrary use of personal data, data localization is necessary.
  4. Digital technologies like machine learning (ML), artificial intelligence (AI) and Internet of Things (IoT) can generate tremendous value out of various data. It can turn disastrous if not contained within certain boundaries.
  5. With the advent of cloud computing, Indian users’ data is outside the country’s boundaries, leading to a conflict of jurisdiction in case of any dispute.
  6. Data localization is an opportunity for Indian technology companies to evolve an outlook from services to products. International companies will also be looking at the Indian market, and this will benefit the growth of the local ecosystem.
  7. More data centres in India could mean new, power-hungry customers for India’s renewable energy market. That means Data localisation could boost India’s renewable energy.

 

Policies that imply data localization:

The Srikrishna Committee wants to localise data for law enforcement to have easy access to data, to prevent foreign surveillance, to build an artificial intelligence ecosystem in India, and because undersea cables through which data transfers take place are vulnerable to attacks.

Reserve Bank of India has also imposed a hard data localisation mandate on payment systems providers to store payment systems data only in India.

Barring limited exceptions, telecom service providers are not allowed to transfer user information and accounting information outside India.

Goals set in the Draft National Digital Communications Policy 2018, and the Guidelines for Government Departments for Contractual Terms related to Cloud Storage 2017, draft e-commerce policy and the draft report of the cloud policy panel show signs of data localization.

 

Concerns / Challenges:

  1. Several of the recommendations in including the draft e-commerce policy, falter on a key ground like they gloss over the negative economic impact of data localization. This approach exhibits lack of evidence-based policy making.
  2. Having data in India does not mean that domestic companies will be able to access this data. Localization might aid the growth of the data centre and the cloud computing industry in India, but as matter of wider public policy, such an approach is extremely myopic.
  3. Mandating localization is less of a solution for data protection and might be less relevant to promote e-commerce.
  4. Given the comparative trade advantages enjoyed by one section of Indian industry in this context, mandating a strict data localization regime could be perceived as a restrictive trade barrier and spur retaliatory measures.
  5. There is a possible rise in prices of foreign cloud computing services in case of a data localisation, and its impact on MSMEs as well as start-ups relying on these services.
  6. The possibility of triggering a vicious cycle of data localisation requirements by other countries as a response to India’s possible data localisation will be detrimental for the global data economy.
  7. Growth will be restricted if data cannot be aggregated internationally. Infrastructure in India for efficient data collection and management is lacking.

 

Need of the hour:

  1. There is an urgent need to have an integrated, long-term strategy for policy creation for data localisation.
  2. Data localisation needs to integrate a wide range of social, political and economic perspectives.
  3. Creating an opportunity for local data centres all over the country.
  4. Devising an optimal regulatory and legislative framework for data processors and data centres operating in the country.
  5. Adequate infrastructure in terms of energy, real estate, and internet connectivity also needs to be made available for India to become a global hub for data centres.
  6. Adequate attention needs to be given to the interests of India’s Information Technology Enabled Services (ITeS) and Business Process Outsourcing (BPO) industries, which are thriving on cross border data flow.

SEBI and it’s autonomy:

Context: As part of the Finance Bill introduced in Parliament, the Centre had proposed amendments to the Securities and Exchange Board of India Act, 1992 that were seen as affecting SEBI’s financial autonomy.

 

What’s the issue?

The amendments required that after 25% of its surplus cash in any year is transferred to its reserve fund, SEBI will have to transfer the remaining 75% to the government.

It was felt that the Centre’s decision to suck out SEBI’s surplus funds will affect its autonomy. Therefore, SEBI asked the centre to reconsider its decision.

But, the government has rejected the plea, thus paving the way for further conflict.

 

Analysis:

Prima facie, there seems to be very little rationale in the government’s decision to confiscate funds from the chief markets regulator.

For one, it is highly unlikely that the quantum of funds that the government is likely to receive from SEBI will make much of a difference to the government’s overall fiscal situation
